1. | License Grant

Subject to the terms of this EULA, NextFUR grants the User a limited, free, non-exclusive, non-transferable, non-sublicensable, and non-revocable license (except as provided in the Termination clause) to install and execute a copy of the Software on your device for personal purposes.

1.1. Scope of Permitted Use:

• Individuals: Strictly personal, recreational, and non-commercial use.
• Academic Institutions: Educational and research use, without commercial purposes.
• Commercial Prohibition: It is strictly prohibited to use this Software for commercial purposes (such as access rental, or selling aggregated services) without the prior, express, and written authorization of NextFUR through the developer panel.

1.2 Modifications to the EULA

NextFUR reserves the right to modify this EULA at any time. Any changes will be published at https://nextfur.net/eula and will take effect immediately upon publication. Continued use of the Software after such modifications constitutes acceptance of the new terms; in the event of substantial changes, users who have already accepted these terms will be notified through appropriate means.

2. | Intellectual Property and Content

2.1. NextFUR Ownership:

The Software, including its source code, design, visual interfaces, graphics, "look and feel", trademarks, logos, text, sound, and all content generated internally and natively by NextFUR (hereinafter "Proprietary Content") are the exclusive property of NextFUR LTDA Organization and are protected by Brazilian copyright laws and international treaties.

2.2. Internal Content Protection:

The User acknowledges that they acquire no ownership rights over the Proprietary Content by using the Software. Extraction, copying, reuse, or exploitation of digital assets created by NextFUR for use outside the NextLauncher environment without permission is prohibited.

2.3. Feedback and Suggestions:

Any feedback, idea, suggested modification, or contribution sent by the User to NextFUR regarding platform operation grants NextFUR a perpetual, irrevocable, worldwide, and royalty-free license to use, modify, and commercialize the feedback without obligation of royalties or compensation to the User.

3. | Third-Party Content and Disclaimer of Liability

NextLauncher operates as a distribution and management platform (similar to platforms like Steam, Epic Games Store, and Curseforge) that allows downloading and running games, modifications ("Mods"), resource packs, and software developed by third parties.

3.1. Distributor Nature:

NextFUR acts merely as a technical facilitator for downloading and installing such content. NextFUR is not the developer, creator, or owner of third-party games or mods made available on the platform, except when explicitly indicated.

3.2. Risks and Responsibility:

The User acknowledges and agrees that:

• Downloading and using third-party software is done at your own risk
• NextFUR IS NOT RESPONSIBLE for the functionality, stability, security, or content of third-party mods and games.
• NextFUR does not guarantee that third-party content will be free of viruses, malware, or malicious code, although it strives to maintain platform security.
• NextFUR is not responsible for software conflicts, crashes, or operating system damage resulting from non-official modifications.

NextFUR will be responsible for:

• Ensuring the integrity and security of the NextLauncher platform.
• Providing technical support related to Software operation (accessible via the Discord platform link https://nextfur.net/discord).
• Maintaining the confidentiality of User data according to the privacy policy (stated in clause 6).

3.3. Third-Party Licensing:

The use of games and mods downloaded through NextLauncher is subject to the EULAs and terms of use of their respective creators. The User is responsible for verifying and complying with such terms.

4. | General Conduct Restrictions

To protect the integrity of the Software and intellectual property, the User agrees NOT TO:

• Reverse Engineering: Decompile, disassemble, reverse engineer, or attempt to derive the source code of NextLauncher.
• Bypass Protections: Attempt to crack, emulate, or bypass any encryption, security, or authentication system of the Software.
• Unauthorized Distribution: Copy, distribute, rent, sell, or make available the Software on other websites or repositories without permission.
• Illicit Use: Use the platform to host, disseminate, or facilitate access to illegal content, piracy, child pornography, or malicious software.
• Unauthorized Access: Attempt to gain unauthorized access to any parts of the Software, associated servers, or connected networks.

5. | Community Guidelines and Interaction

NextLauncher offers social features, chats, forums, and integration with game servers. Access to these tools is a privilege, not a right, and can be revoked if the User violates the standards of conduct below:

5.1. Respect and Civility:

Any hate speech, discrimination, racism, homophobia, xenophobia, sexism, or any form of prejudice against inherent characteristics of an individual or group is prohibited. The environment must be safe for everyone.

5.2. Harassment and Bullying:

Harassment (harassment), stalking (stalking), threats to physical or moral integrity, disclosure of third-party personal data (doxing), or encouragement of suicide and self-harm are not tolerated.

5.3. Inappropriate Content:

Sending, uploading, or linking sexually explicit content, pornography, extreme graphic violence, or grotesque content in community areas (profiles, global chats, forums) is prohibited.

5.4. Spam and Disruption:

Mass messaging (*flood*), unauthorized advertising, scams (*scam*), phishing links, or any action aimed at interrupting the normal flow of user communication is forbidden.

5.5. Impersonation:

The User may not impersonate NextFUR Staff members, developers, celebrities, or other users in order to deceive, defraud, or gain undue advantage.

5.6. Cheating and Fair Play:

In multiplayer games accessed via NextLauncher, using cheat tools (*hacks, cheats, aimbots*), bug exploits (*exploits*), or any modification giving an unfair advantage over other players is prohibited, under penalty of a global platform ban (HWID Ban).

5.7. Disrespect Towards Staff and Collaborators:

Offensive, disrespectful, or threatening comments directed at NextFUR team members, moderators, or collaborators will not be tolerated and may result in severe sanctions.

5.8. Reports and Moderation:

The User is encouraged to report any violation of these guidelines through official support channels. NextFUR reserves the right to investigate and take disciplinary action, including warnings, temporary suspensions, or permanent bans, as it deems appropriate.

5.9. Omission / Misconduct:

Failure or omission to report serious violations of these guidelines, especially those involving security, harassment, or illegal activities, may be considered a violation of this EULA and subject the User to sanctions.

NextFUR clarifies that it does not sanction omission in a generalized manner. Sanctions will be applied solely and exclusively in cases of intentional omission regarding severe violations.

5.10. Conspiracy:

Any attempt to organize, plan, or participate in activities aimed at damaging the integrity, security, or operation of the Software, the NextFUR community, or its users will be considered a severe violation of this EULA.

5.11. Compliance with Laws:

The User agrees to comply with all applicable local, state, national, and international laws when using the Software and interacting with the NextFUR community.

Consequences

Violation of these rules will result in measures ranging from warning, temporary suspension, muting, up to definitive account termination and revocation of access to the Software or, in further cases, applicable legal measures.

6. | Privacy and Data Policy

Use of the Software is conditioned upon acceptance of our Privacy Policy, available at https://nextfur.net/terms.

6.1 Data Collection:

The Software may collect technical data (hardware, error logs) and usage data for service improvement, security, and statistical purposes.

6.2 Monitoring:

NextFUR reserves the right (but not the obligation) to monitor public chats and platform interactions to ensure compliance with this EULA.

7. | Updates and Maintenance

NextFUR may deploy or provide patches, updates, and modifications to the Software that must be installed for the User to continue using the Software. NextFUR may update the Software remotely without notification to the User, and the User consents to the deployment and application of such updates.

8. | Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTIES FOR USE. EXCEPT FOR MANDATORY LEGAL WARRANTIES AND RESPONSIBILITIES EXPRESSLY ASSUMED IN CLAUSE 3.2 OF THIS AGREEMENT, NEXTFUR DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEXTFUR DOES NOT GUARANTEE THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FUNCTION ON ALL HARDWARE CONFIGURATIONS.

9. | Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEXTFUR LTDA BE LIABLE FOR ANY PERSONAL INJURIES (EXCEPT IN CASES OF WILLFUL MISCONDUCT OR GROSS NEGLIGENCE BY NEXTFUR, SUBJECT TO LEGAL LIMITS), INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGE OR LOSS ARISING FROM OR RELATED TO THE USE OR INABILITY TO USE THE SOFTWARE.

10. | Termination

This EULA remains effective until terminated.

10.1 By the User:

The User may terminate at any time by uninstalling the Software and destroying all copies.

10.2 By NextFUR:

NextFUR may terminate this EULA immediately if the User violates any terms established herein or Community Rules or by internal administrative decision.

10.3 Effects of Termination:

Upon termination, the User must cease all use of the Software and delete all copies. Termination for rule violation implies loss of account access, achievements, and associated virtual items, without right to refund or compensation, except where purchase occurred within less than 7 days without fraud during the transaction.

11. | Governing Law and Jurisdiction

This Agreement shall be governed by and construed exclusively in accordance with the laws of the Federative Republic of Brazil. The Judicial District Court of the Capital of the State of São Paulo is elected to settle any disputes arising from this contract, waiving any other jurisdiction.

This clause does not apply to consumer relations.

12. | Consent

By installing or using the Software, you declare that you have read and understood this EULA, as well as the Community Guidelines and Privacy Policy, and agree to abide by their terms and conditions.
